TERMS & CONDITIONS

“you” or “your” means the participant.

“we”“us” or “our” means Mundo Verde.

Contract means the contractually binding agreement made between us and you that is made up of the application form and the terms and conditions set out in this document.

Start Date means the date, agreed upon with you in advance, that the programme  begins.

Initial Deposit means the part of the Program Fee that must be paid by you in order to secure your place on the Programme prior to payment of the balance of the Programme Fee, such balance being payable in accordance with clause 2.2 a. below.

Participant means a participant on the Program and Participants means all and any Participant.

Placement Deadline means the date 21 days prior to the Commencement Date.

Programme means all  the activities as set out in this document and/or placement itself offered by Mundo Verde.

Placement the placement that we are providing to you as set out in your application or as otherwise agreed between us and you

Programme Fee means the sum of the Deposit and the remaining balance, payable by you to us in accordance with Section 3 below.

Mundo Verde means Mundo Verde E.I.R.L, a Peru registered company.

Unless otherwise agreed, these Terms & Conditions apply to all programmes provided by Mundo Verde. They are amended from time to time due to changing circumstances; the Terms & Conditions at the time of booking a programme are the Terms & Conditions  that are valid. By booking, you confirm that you and all participants associated with you under the booking have read this Terms & Conditions and have agreed to be bound by them, and that you have the authority to accept them on behalf of all participants associated with you under the booking. In these Terms & Conditions, “you” therefore means you and all participants associated with you under the booking.

Terms & Conditions apply to all programmes provided by Mundo Verde

1. Our Contract with you

1.1 Please carefully read these Terms and Conditions and make sure you understand each and every part of it. Ensure that you fill out the booking form properly before submitting your application. Should you require any changes or if you think there has been a mistake with your application please let us know in writing and we will confirm any changes made in the same way so we are certain there is no mistakes.

1.2 By submitting your application form it does not mean that your placement has already been approved. Your placement will usually be approved within one to three weeks after submitting the form. If for any reason we would not be able to supply you with your placement we will inform you about it in writing or by telephone.

1.3 When we accept your application form and the following happens:

  • You pay the stipulated deposit to us; and
  • We confirm in writing that your placement has been accepted

Only then we will have a contract that will be binding between you and us. If for any reason we could not deliver the placement to you stated in your application, we will let you know about this and we will try to rearrange another placement or equivalent or refund the deposit you have made.

 

2. Price of our placements and payment

2.1 The fixed cost of the programme is described in the price list of our programmes and will be the price to pay at the time of confirming your placement. It should be understood that the prices stipulated in our price list are fixed from two-week electives and increase according to the duration of the elective. To avoid any misunderstanding, we will confirm the Price for your placement at the time we confirm your placement itself as stated in clause 1.3. Our Price may be changed at any time but this will not affect your placement that we have previously confirmed. This price includes all the listed in the ‘What’s included’ list of our programmes and does not include flights of any kind, insurance of any kind and food, unless otherwise stated.

2.2 Payment of your placement will be as follows

a. You will pay an initial deposit of US$200 within the 2 – week period of time after receiving your acceptance letter from us which will confirm your placement. Please note that this initial deposit of USD200 dollars will be deducted from the final balance, which must be paid in full up to four weeks prior to the start of your elective.

b. If you book more than one placement with us then you must pay the initial deposit of US$200 for each placement within the 2-week period of time after receiving your acceptance letter from us which will confirm your placements and the balance for both placements before the first one takes place.

c. For programmes that are split between two or more countries, the programme fee is due 2 months prior to your start date given there are more advanced preparations involved.

d. Failure to pay the programme fee on the agreed dates will lead to an automatic cancellation of the placement and the Initial Deposit shall NOT be refunded unless otherwise agreed.

e. Amendments to your payment dates are entirely at the discretion of the Mundo Verde team.

f. Once the application is accepted and reservation deposit duly paid, the programme fee cost is guaranteed and will not change so long as the proposed start date, including postponement by you is within one year of the date of application.

g. Programme fee prices on the website are subject to change without warning. Whenever such changes occur, we will notify you of the increments.

h. All fees are payable in US Dollars

i. You agree that no part of the programme fee is refundable once the programme has commenced. This means that no refunds are issued should you spend less time on your programme because of illness or personal travel or any other reason whatsoever.

j. All your rights to a refund on cancellation either by you or by us are set out in clause 6

 

3. Amendment, cancellation, curtailments by you to the placement

3.1 Any amendment, postponement or cancellation to your placement must be presented in writing to admin@electiveplacements.com only to our main team in Peru.

3.2 Given that we do not have a registration fee, the US$200 deposit you have made is non-refundable should you chose to cancel your placement.

3.3. In case you decide to cancel after you have completed your payment, we will be unable to give you a full refund. We will deduct all the expenses we have incurred and our expenditures and will refund part of your payment which in a case like this is no more than 80% of the total amount of the balance that you have paid.

3.4 You are welcome to request a postponement of your placement in writing to admin@electiveplacements.com  up to 12 weeks before your placement begins. We will then reconfirm in writing the new dates for your placement. This has no extra cost, however, we will not accept responsibility for any extra cost you may incur as a result of the postponement of your placement start date such as, but not limited to flight ticket penalties, bus ticket penalties, travel and health insurance, liability insurance, tours included in our placements and visa fees.

3.5 Should you need to amend your placement or any of the included programmes in your placement, we will do our best to do so, however we cannot guarantee that this amendment will be executed. We will not accept responsibility for any extra cost you may incur as a result of this amendment of your placement or any of the programmes included in your placement such as, but not limited to flight ticket penalties, bus ticket penalties, travel and health insurance, liability insurance, tours included in our placements, Spanish classes (if included) cooking classes or dance classes (if included) and visa fees.

3.6 In the event you need to curtail your placement, therefore not being able to complete your placement, we will be unable to refund you any money paid for your placement. Any additional expense or cost as cause of this curtailment will be entirely covered by you and we will not accept any responsibility for this.

 

4. Amendment, cancellation and/or no show of the programmes included in the placement by you.

4.1 Should you choose to cancel your Spanish lessons for any reason without previous notice, this lessons will not be recovered and we will be unable to refund any money for this.

4.2 If you need to make any changes to your fixed Spanish lessons, the request has to be sent in writing either to admin@electiveplacements.com or the WhatsApp number provided at the beginning of your placement. We will do our best to do so, however, we cannot guarantee that this change will be executed.

4.3 If you do not show up for your Spanish lessons, the lessons supposed to be delivered will not be recovered and shall not be refunded.

4.4 If for any reason you need to change the date of your cooking classes, the request should be sent in writing to admin@electiveplacements.com or the WhatsApp number provided at the beginning of your placement at least one week in advance. We will do our best to do so, however, we cannot guarantee that this will be executed. If you don’t send your request in writing and don’t show up to your cooking class, this will be considered as delivered, therefore no refund will be made.

4.5 If for any reason you need to change the date of your dance classes (salsa or tango), the request should be sent in writing to admin@electiveplacements.com or the WhatsApp number provided at the beginning of your placement at least one week in advance. We will do our best to do so, however, we cannot guarantee that this will be executed. If you don’t send your request in writing and don’t show up to your dance class, this will be considered as delivered, therefore no refund shall be made.

4.6 If for any reason you need to change the date of any of the tours included in your placement, the request should be sent in writing to admin@electiveplacements.com or the WhatsApp number provided at the beginning of your placement at least one week in advance. We will do our best to do so, however, we cannot guarantee that this will be executed. If you don’t send your request in writing and don’t show up to your fixed tour on the stipulated date, this will be considered as delivered, therefore no refund shall be made. If the requested amendment to the tour can be done, we cannot accept responsibility for any extra cost that you may incur as a result of this change.

 

5. Amendment, cancellations and curtailment to your placement by us

5.1 In very rare occasions, placement details such as change of placement hospital or accommodation may differ from the original information shared with you. In such a case, we will do everything possible to deliver a placement as good as what was contracted.

5.2 Dates, schedules, programme details, and cost are given in good faith, based on information available and in force at the time they are given and are subject to change and revision in the event of a change of circumstances. In the event that you are registered for the placement to a location that has no other participant signed up to 2 months to their start date, Mundo Verde will in writing notify you of the change of location to where there are other participants.

5.3 You will, in writing, notify us of Acceptance or Rejection of this Change.

5.4 In case of acceptance, we shall organise for the change of location to a hospital with a similar opportunity for your placement. We will not be liable for any costs that may arise as a result of this change including but not limited to flights.

5.5 In the case of Rejection of such change, you shall inform us of your decision within 10 days of receiving the information. We will organise for the refund of the full placement fee paid.

5.6 Should you want to continue with the placement in the same location alone, you will incur a total of 50% of the placement fee paid as an extra cost.

5.7 When there is not a Force Majeure event, in the very rare occasion that we need to cancel your placement, we do not need your consent to do this and we will inform you at least 30 days before your placement start date and refund you fully within 30 days of informing you. We will not have any further liability beyond the full refund of placement fees we received and we will not accept responsibility for other costs you may incur for example but not limited to flight ticket penalties and insurance, vaccinations and visa and work permit fees.

5.8 However, where a cancellation is necessitated by circumstances beyond our control or by Force Majeure causes such as natural disasters, extreme political instability, security threats, terrorist activities etc., you will be notified as soon as it’s reasonably possible since the occurrence of the event.

5.9 If these events persist, we will work with you to organise a similar placement in a different location, or country. This will involve additional costs to you such as: change of ticket to a new location, programme fees difference.

5.10 You may also opt to change your placement dates for the same location to a further date at no extra cost to you.

5.11 In the event of sector specific variables such as a strike in the public health facilities, or any strike in another sector that directly affects the normal performance of your placement, we will do our best to deliver your placement as good as what was contracted in a private hospital within the same location. Any extra costs arising out of this change, such as transport or increase in hospital fees, will be taken care of by you should you accept this change.

5.12 Failure to pay the programme fee at the agreed dates will lead to an automatic cancellation of the placement and the Initial Deposit shall NOT be refunded unless otherwise agreed.

 

6. Force Majeure Events

6.1 We shall not be liable or responsible for any failure to perform delivery of your placement, delay in performance of any of our obligations under these Terms that is caused by a Force Majeure event which is outside our control, this means any act or event beyond our reasonable control, including without limitations:

a. Health threat triggered by an epidemic or pandemic.

b. Nuclear, chemical or biological contamination or sonic boom.

c. Terrorist attack, civil war, civil commotion, or riots, war, threat or preparation for war, armed conflict, imposition of sanctions, embargo or breaking off of diplomatic relations.

d. Collapse of building, fire, explosion or accident.

e. Any labour or trade dispute, strikes, industrial action or lockouts.

f. Non-performance by suppliers or subcontractors.

g. Interruption or failure of utility service.

h. Sickness

i. Environmental or climate concerns.

j. Acts of government or local authority.

k. Natural disasters.

or any other event or circumstance which amounts to a Force Majeure event.

6.2 In such case, if we consider that this delay shall exceed 30 days, we may terminate this contract and will inform you at least 30 days before your placement start date and refund you fully within 30 days of informing you. We will not have any further liability beyond the full refund of placement fees we received and we will not accept responsibility for other costs you may incur for example but not limited to flight ticket penalties and insurance, vaccinations and visa and work permit fees.

6.3 If a Force Majeure event arises that affects the performance of our obligations to you under these terms we will contact you as soon as reasonably possible to notify you.

 

7. Refund

7.1 Any situation that merits consideration for a refund must be evaluated by us. In the event that a request for reimbursement is declared to be appropriate, the following procedure shall be followed:

7.2 Under no circumstance the US$200 dollar deposit shall be refunded should you decide to cancel your placement or should we have to cancel due to Force Majeure situation.

7.3 When you cancel your placement

If your placement has been paid in full at the time of requesting a refund we will proceed:

a. Notice of between 30 and 17 weeks before the start date of your placement 80% of the balance paid in full.

b. Notice of between 16 and 13 weeks before the start date of your placement 60% of the balance paid in full.

c. Notice of between 12 and 9 weeks before the start date of your placement 50% of the balance paid in full.

d. Notice of between 8 and 5 weeks before the start date of your placement 30% of the balance paid in full.

e. Notice of 4 weeks before the start date of your placement 10% of the balance paid in full.

f. If you cancel your elective three weeks or less before the start of your placement, there is no refund at all.

g. Any refunds for whatever reason will be sent out within 30 days of the refund decision date.

h. All refunds are paid via bank transfer.

i. We do not withhold any processing fee or service charge from refunds. However, the refund amount you receive may be less than you expected, due to fees or charges imposed by your bank or by other intermediaryfinancial institutions. We have no control over this and cannot cover or reimburse these fees.

j. All refunds and reimbursements will be processed within 30 days.

7.4 When we cannot provide the service

If on the other hand, we cannot deliver your placement, we will proceed as follows:

a. In the very rare occasion that we need to cancel a placement, we will inform you at least 30 days before your programme start date and refund you fully within 30 days of informing you. We will not have any further liability beyond the full refund of placement fees we received.

b. In the event of a Force Majeure situation described in section 6 of this contract, partial refunds should be made after deducting payments and expenditures we incur. You will be notified as soon as it’s reasonably possible after the occurrence of the event. 

c. If you decide to request another type of reimbursement related to extracurricular activities, these are determined by the following clauses: 3.5, 4.1, 4.2, 4.3, 4.4, 4.5 and 4.6 of this document.

 

8. Visa

8.1 We offer advice on how to obtain the appropriate type visa and work permits for your placement, however, the issuance of these documents is subject to the judgment and criteria of the relevant authority and it is beyond our control and we are not responsible if you cannot obtain the relevant visa and work permits for your upcoming placement. Visa and work permit requirements may change at any time and it is your responsibility to ensure that you have the correct visa and/or work permit for your placement with us. You are expected to pay for the issuance of any visa or work permit. You must be aware that we will not accept responsibility of the consequences should a change of requirements for visa or work permit arise.

8.2 You are responsible for ensuring that your passport, visa and other documents are valid before and during your placement with us.

8.3 You should know that visas and work permit are valid for voluntary work in this placement with Mundo Verde only and that you will not be able to participate or engage in any type of paid work and that it is your entire responsibility to be aware of this and that if you violate these rules it can be considered a serious offence and that you could be prosecuted for this fact.

 

9. Insurance

9.1 When you enrol in one of our placements abroad you should know that this involves a certain degree of risk and it is your obligation to pay for and to be protected by a transparent and comprehensive travel and health insurance and professional indemnity insurance cover.

9.2 We do not provide any kind of advice to hire a travel or health insurance nor a professional indemnity insurance, therefore, it is your responsibility to hire and be covered by these types of insurance. We do not accept responsibility if for any reason you are not covered by appropriate insurance in case of any loss, injury, or otherwise (provided such injury is not related to an act or omission on our part). It is also your responsibility to give us the detailed information of those insurances before your placement begins.

9.3 You must make sure that you are covered by a comprehensive and appropriate insurance for the duration of your participation of your placement with us. You must also make sure that your insurance policy should fully cover:

a. Medical coverage for the duration of your elective with us.

b. Coverage of your trip for your placement between the country of your residence and the country in which your placement will take place.

c. Loss, theft or damage of your personal belongings or your money.

d. Your repatriation and that of your belongings to your home address in the country of your residence.

f. Your death or personal injury.

g. Unforeseen delays and cancellation of flights.

h. Activities with a greater risk should also be covered.

9.4 You must have in place appropriate professional indemnity insurance coverage for the duration of the placement that will indemnify and hold us harmless, the hospital or other placement setting and its employees, servants and agents against all liabilities, costs, expenses, losses including but not limited to any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal costs (calculated on a full indemnity basis) and all other reasonable professional costs and expenses, damages, injuries or judgements in any way caused by your negligence or wrongdoing provided you are working under the supervision of an appropriately qualified practitioner.

9.5 You must provide full details of this professional indemnity insurance to us before your placement begins.

9.6 Mundo Verde will not be held liable for any costs arising from the failure to take an appropriate insurance.

9.7 Mundo Verde shall not accept responsibility for any loss or damage to your property during your placement considering that this loss or damage is not caused by our negligence.

9.8 You must bring all relevant insurance documents with you to the country or countries where your placement will be taking place.

 

10. Delivering our service

10.1 According to our Terms we will supply your placement on the agreed date between you and us.

10.2 We will do our best to fulfil the execution of your placement in the agreed dates. However, there may be delays or cancellations.

a. Due to a Force Majeure event that is outside of our control and that are detailed in section 6 and clause 5.11

b. We confirm in writing that we are unable to deliver the placement

10.3 If you do not pay us for your placement as agreed and stated in clause 2 it is at our discretion to cancel your placement or suspend it with immediate effect until payment has been made. We will make sure you will be contacted to tell you this should this event happens.

 

11. Our Liability to you

11.1 If we fail to comply with these terms, we shall be liable for any loss or damage you may suffer as a foreseeable result of our breach of these terms or our negligence, but we shall not be liable for any loss or damage you suffered which is not foreseeable.

Loss or damage is considered foreseeable if it is a direct consequence of our breach or our negligence.

11.2 Mundo Verde has no liability for other arrangements or travel arrangements outside your placement and we do not accept responsibility beyond your placement period. Baggage and personal effects are the sole responsibility of the owners at all time.

11.3 We have no liability or responsibility to you for any loss of profit, loss of business, business interruption or termination or loss of business opportunity.

11.4 We cannot accept any responsibility or liability for placement changes or your placement cancellations or part of your placement under circumstances described in clause 6.1 and in such cases no refund or compensation for any loss will be given to you unless otherwise decided at our sole discretion.

11.5 We do not accept any responsibility or liability for placement changes or your placement cancellations or part of your placement under circumstances described in clause 5.11.

11.6 We take no responsibility and are not liable for any third party behaviour or actions including but not limited to that extracurricular activities providers included in our programmes.

11.7 We take no responsibility and are not liable for any accidents that take place at any third party locations including but not limited to the premises of the host placement provider and the designated accommodation and we are not liable for any injury, damage, loss, accident, delay or other irregularity or inconsistency that may be caused by or as a result from:

a. Any defect in any vehicle or other equipment other than our own.

b. The negligence or failure of any person, company or other legal entity involved in carrying out or performing any of the services included in your placement other than our own negligence or failure or that of our own employees.

It is your responsibility to ensure you purchase all appropriate insurance described in section 9 prior to the commencement date of your placement.

11.8 Please note that we accept to process your booking based on the understanding that you come on the placements at your own risk after carefully evaluating all the risks involved in it. There is no way for us to be responsible for any actions or omissions of any party involved in your placement over which we have no direct control such as governments, airlines, local transportation service providers, and others. Similarly important, we are not responsible for any loss or expense described in clauses 5.11, 6.1 of any unconnected third parties.

11.9 Independent contractor status / no agency relationship; Mundo Verde has secured the services of independent subcontractors (to provide some services and to conduct some of the activities that participants may engage in). Although Mundo Verde has made efforts to select responsible subcontractors, these subcontractors are not employees or agents of Mundo Verde, and Mundo Verde is not responsible and we have no liability for the actions of its subcontractors.

11.10 We reserve the right to make charges for any missing or damaged items or for any additional cleaning or repair charges to accommodation that may be incurred during the programme. You agree to pay these charges in full to us within 10 days of finishing your placement.

 

12. Your responsibility

12.1 International flights are not included in the cost of any of our Programmes. It is your sole responsibility to arrange flights and insurance and to select providers based on your own decisions and experiences. We cannot be held responsible for any action, negligence or event relating to the purchase or operation of flight tickets or flights. We will also not be responsible for any costs or refunds due to changes or delays in flights. You should carry a credit card or other means to pay for expenses arising from trip cancellations or delays and unexpected flight costs related to changes or purchases of any new tickets.

12.2 You are responsible to ensure that your passport is valid to travel to the program destination(s) and to obtain the relevant visa(s) or work permits. While, Mundo Verde it cannot be held responsible if a visa application is denied or if a visa is not obtained in due time.

12.3 You are solely responsible for ensuring that you are in good health, both physically and psychologically, and that you do not suffer from any condition that could negatively impact the programme and/or compromise the well-being of you or other participants on the program. Mundo Verde reserves the right to dismiss a participant from the program on these grounds either during the program or before the program begins. You are also responsible to seek your physician’s advice on vaccinations and medical precautions. You must immediately report any accidents, incidents, illnesses, injuries or health issues of any kind that occur with you or other participants during the programme to Mundo Verde staff.

12.4 You are solely responsible to hire all appropriate insurance as described in section 9 and all its clauses.

12.5 You are solely responsible for getting and taking HIV Post Exposure Prophylaxis kit to the country where your placement will take place.

12.6 You agree to make all programme payments as described in section 2.

12.7 Travel with an open mind; be respectful to the culture and customs of the country your placement is taking place. This means practicing patience and understanding even when you do not agree with certain issues.

12.8 Understand that though responsible alcohol consumption is permitted gross misbehaviour will result in the termination of your programme. This includes being inebriated to the point of losing control, harming others or damaging property. You must not consume alcohol at your placement site (hospital, centro de salud, clinic, any other legal entity or while en route to these places). This is cause for immediate expulsion from the programme.

12.9 We reserve the right to take appropriate action if during your placement:

a. Your actions or omissions would be considered or expected to be offensive towards hosts, Mundo Verde staff, work colleagues, patients or others, to breach the rules, regulations, policies or other lawful directions of the hospitals and/or other institutions, to endanger the welfare and/or the safety of other people or risk damage to property.

12.10 You will take full responsibility for your conduct at all times during the programme. You will not act irresponsibly nor will you break the law of the country to which you go. You will not put yourself or others in dangerous situations. If you do any of the above you will be responsible for the consequences.

12.11 Please note that Mundo Verde reserves the right to decline to accept any person to be part of a placement, or to require any participant to withdraw at any time, when such action is determined by the appropriate Mundo Verde staff representative to be in the best interests of the health, safety, and general welfare of the programme or of the individual participant. In such a case, Mundo Verde accepts no responsibility for any airline cancellation penalty incurred by the purchase of a non-refundable ticket or any other cost that you may incur.

12.12 Treat all people with respect and dignity, especially the elders of the community.

12.13 Dress properly with regard to the local culture, as well as weather conditions. Realise what is socially acceptable in western countries, can be considered offensive in others.

12.14 Avoid all political demonstrations and activities. Remember you are guests in the host country and subject to local laws and punishment.

12.15 Acknowledge the program and accommodations provided are customized for you and not changeable in country without approval and consent of Mundo Verde.

12.16 Advise the Mundo Verde staff of weekend travel plans.

12.17 Respect the policies of the community and the rules in which you are staying.

12.18 Seek permission before inviting guests to the accommodation provided by us.

12.19 Overnight guests are not allowed in the Mundo Verde accommodation unless otherwise agreed.

12.20 Respect the accommodation; you will be liable for any damage you may cause.

12.21 Keep your room clean and neat.

12.22 No smoking inside your accommodation.

12.23 If your placement is suspended permanently and you decide to stay in your destination country beyond the date of suspension, we would have no further responsibility for your accommodation, insurance or travel arrangements and you would have to take care personally of finding and paying for your accommodation, insurance and travel. Should you choose to travel back home in the event that your placement has been suspended and this means you require a different flight to return home from the one you already have, you are solely responsible for the cost of any changes made to your flight ticket or the cost of a new flight ticket in case you are unable to make any changes to your original flight ticket.

 

13. Our undertakings

13.1 In return for receipt of the placement fee, we will undertake the following:

a. Provide you with the hospital attachments in as many destinations as included in your placement.

b. To provide you with the language course (where included in our programme).

c. To provide you with the dance classes as agreed (where included in our programme).

d. To provide you with cooking classes (where included in our programme).

e. To provide furnished accommodation that meets the following minimum standards:

  • With a bed in your bedroom (double occupancy basis with twin beds);
  • With a wardrobe in your bedroom;
  • With facilities for cooking and for the hygienic storage of food;
  • With adequate bathroom, toilet and shower facilities;
  • With bed sheets;
  • With gas, electricity, water and Wi Fi internet access for which we will cover the payment of bills;

for the duration of your internship programme. If you wish to stay in the accommodation for a longer period, before or after your placement, we can attempt to arrange this for you. However, we cannot guarantee any accommodation outside of the period of your placement, and the cost of any such accommodation is entirely your responsibility.

f. To provide you with return bus tickets to a second destination as part of your placement (where included in our programme)

g. To provide you with safe and secure accommodation while in this second destination.

h. To provide you with a transfer, at a time agreed between us, from the arrival point be it the closes airport, bus terminal or any other type of terminal to your accommodation on your arrival, prior to your commencement on your placement.

i. To provide you with all the tours and excursions included in your programme.

j. To provide contact details of local staff in case of any difficulties or problems experienced and to facilitate emergency support if necessary;

k. To provide an induction and welcome talk upon your arrival.

l. To provide you with information and tools to enhance your professional development.

13.2 Mundo Verde will select a minimum of 1 designated staff member to attend the programme. We will be responsible for hiring, screening and selecting our staff member/s, including conducting appropriate staff background checks.

13.3 We will arrange for scheduled programme activities, as described in the program itinerary.

13.4 Medical and emergency response; we will provide or arrange for first aid and/or emergency care for injury or illness occurring during the programme, including arranging for emergency evacuation or transportation. As described in clause 9.6, you agree that Mundo Verde is not responsible for the provision of emergency medical insurance for participants, unless officially part of the programme services and fees. Such insurance needs to be obtained by you and all other participants directly. As a result, Mundo Verde will not be financially responsible for first aid and/or emergency care responses.

13.5 For the avoidance of doubt, we will only be responsible for and are only bound to provide the services and matters set out in Section 16 below.

 

 14. Website and promotional material

14.1 The content and information displayed on our website and other promotional material is believed to be valid and correct but we will not be held liable and do not take responsibility for any misinformation or ambiguities in the content. Prices are subject to change without notice and you will be liable for additional amounts owed due to price changes unless your deposit has already been submitted.

14.2 We reserve the right to take your photograph, or video footage of you, for use in our promotional material. We do not make any payments to individuals in respect of such use. We may (but are not obliged to) reproduce the photographs (or part of them) in our promotional material including, without limitation, posters, advertisements, printed publications, on our website and social media website pages. Copyright in the photographs will belong to Mundo Verde. Photographic data is personal and therefore we will not use the images taken without your consent and we will not use your image, or any other information you provide, for any other purpose. By agreeing to these terms and conditions, you consent for your photographic data to be used for our promotional purposes.

 

 15. Experiencing problems

15.1 Mundo Verde wants you to enjoy a worry-free placement and we are here to help in every way possible.  Should you experience any problems while participating in our placement, you must immediately inform us in writing (by email or WhatsApp to the local number provided), with a clear explanation of the problem. In such an event, we will discuss the problem with you and will discuss ways in which the problem can be solved. We are not responsible for any conversations or anything that is said unless it is recorded in the written form either by email or by WhatsApp message. This is the formal procedure for complaints:

a. Talk to the Mundo Verde in-country manager responsible for your placement, he or she will do their best to help you.

b. If the outcome of your talk is not what you expected, you should present your complaint in writing by email with Cc to complaints@electiveplacements.com

c. If you still think the outcome of your complaint is not fair for you, you should directly complaint in writing to our head office to complaints@electiveplacements.com as soon as possible.

d. If you would like to claim for a compensation, you should inform us by email or in person of this and provide us with full details of such claim no more than 14 days after the end of your placement.

15.2 We have designed this procedure to make sure that we identify and deal with complaints as quickly as possible and as efficiently as intended. If you do not follow this procedure we may not be able to help you and we will not be responsible for problems or complaints not brought to our attention as suggested above.

 

16. What’s included in your placement

16.1 All our programmes are designed to combine both academic and leisure activities to get the most out of your time while undertaking your placement overseas. Included in the overall price of your programme you get the following services:

a. Arrival pickup (from airport or bus terminal)

b. Hospital attachments

c. Bus tickets for second destination (if included)

d. Bus tickets for tours (if included)

e. Accommodation for as long as your placement goes

f. Language classes

g. Cooking class

h. Dance classes (salsa or tango, depending on the destination)

i. Tours and excursions (depending on the destination)

j. Meals at some tours (if included)

16.2 Please note that all services and accommodation are subject to the laws of the country in which they are provided. Mundo Verde reserves the right to make changes in the agreed itinerary whenever, in their sole judgement, conditions warrant, or if they deem it necessary for the comfort, convenience, or safety of the volunteer. Mundo Verde also reserves the right to withdraw without penalty any programme announced.

16.3 We will arrange for all external contractors used during the programme for transportation and for arranged programme activities such as language classes, cooking classes, dance classes and tours/treks. All these listed activities are provided by independent third parties. You should note that Mundo Verde can arrange bookings for these courses, tours/treks and other activities on your behalf but are not appointed agents or representatives of these third parties and cannot accept liability for them or their activities.

 

17. What’s not included in our programme

17.1 We will not include in any of our programmes the following;

a. Flight tickets of any kind

b. Insurance of any kind

c. Meals unless otherwise stated

d. HIV Post exposure prophylaxis kit

e. Boleto Turístico (Cusco placements in Peru only)

 

18. Agreement to indemnify and defend

18.1 You agree to indemnify (indemnify meaning reimburse by payment or otherwise), defend and hold harmless the Mundo Verde company and its owners, officers, directors, employees, agents and representatives (collectively “Mundo Verde”), with respect to any and all claims (including claims of negligence), liabilities, losses, suits and expenses, including court costs and reasonable attorney fees, made or brought by anyone, for any injury, damage, death or other loss to the extent arising out of or related to: 1) your obligations and responsibilities under these Terms & Conditions, and/or 2) your negligence or other wrongful act/s or omission/s. You further agree to release any claim/s you may have against Mundo Verde and agree you will not make a claim or file a lawsuit against Mundo Verde arising out of or related to any of the circumstances identified in this section 15, above.

18.2 Mundo Verde agrees to indemnify you (indemnify meaning reimburse by payment or otherwise), defend you and hold you harmless, with respect to any and all claims (including claims of negligence), liabilities, losses, suits and expenses, including court costs and reasonable attorney fees, made or brought by anyone, for any injury, damage, death or other loss to the extent arising out of or related to: 1) Mundo Verde’s obligations, responsibilities and services provided under these Terms & Conditions, and/or 2) Mundo Verde, including its staff or representatives’ negligence or other wrongful act/s or omission/s.

 

19. Complete text and severability and other terms

19.1 If any provision of these Terms & Conditions is deemed unenforceable, the remaining provisions shall continue in full force and effect.

19.2 This contract is between you and us. No other person shall have any rights to enforce any of its terms.

19.3 A person who is not a party to the Agreement shall not have any rights under or in connection with it by virtue of the Contracts.

19.4 The rights of the parties to terminate, rescind or agree any variation, waiver or settlement under the contract is not subject to the consent of any person that is not a party to this contract.

19.5 If any provision of the contract (or part of any provision) is found by any court or other authority of competent jurisdiction to be invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed not to form part of the contract, and the validity and enforceability of the other provisions of the contract shall not be affected.

19.6 If a provision of the contract (or any part of any provision) is found illegal, invalid or unenforceable, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable or the parties shall negotiate in good faith to amend such provision such that, as amended, it is legal, valid and enforceable, and, to the greatest extent possible, achieves the parties’ original commercial intention.

19.7 The contract and any dispute or claim arising out of or in connection with it or its subject matter or formation (including no contractual disputes or claims) shall be governed by and construed in accordance with the law of Peru.

19.8 Each party irrevocably agrees that the courts of Peru shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with the contract or its subject matter or formation (including non-contractual disputes or claims).

19.9 We reserve the right to amend this document from time to time.

 

20. Release and Acceptance

20.1 By accepting to participate in any of our programmes, you agree that you have read and accepted our Terms and Conditions and further indemnify Mundo Verde from and against all loss, damage and liability which may be suffered or incurred as a result of your act, neglect or default while participating in any of the programmes.
